FCC Exempts Federal Government from TCPA on Official Communications

On Tuesday, July 5, 2016, the Federal Communications Commission (FCC) released a Declaratory Ruling that clarified the Telephone Consumer Protection Act (TCPA) does not apply to calls made by the federal government or on its behalf when conducting official business.  The FCC reasoned the federal government is not a “person” under the TCPA, but refrained from applying the same logic to state and local governments.
